AN ACT
Providing for minimum wages for employee benefits for workers on
projects related to renewable energy.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Wages for
Renewable Energy Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Eligible project." Either of the following:
(1) A project that produces renewable energy and is
financed, funded or paid for, in whole or in part, with the
funds of a public body. The term "funds of a public body,"
for the purposes of this statute, shall include, but not be
limited to, Federal, State or local tax credits, tax

abatements, grants, loans, government agency stimulus funding
or public bond proceeds, regardless of whether the
beneficiary or ultimate recipient is required to pay or pay
back the funds to retire or partially retire any debt.
(2) Energy transformation project.
"Energy transformation project." A project that provides
energy-related goods and services other than electricity
generation and results in a reduction of fossil fuel consumption
and greenhouse gas emissions, including, but not limited to,
electric vehicle infrastructure, weatherization and renewable
natural gas projects.
"Renewable energy." As provided under section 2 of the act
of November 29, 2004 (P.L.1376, No.178), known as the
Alternative Fuels Incentive Act.
"Workman." As defined under section 2(7) of the act of
August 15, 1961 (P.L.987, No.442), known as the Pennsylvania
Prevailing Wage Act.
Section 3. Required wages and employee benefits.
Not less than the prevailing minimum wages and employee
benefits as would be applicable to a project of public work
pursuant to the act of August 15, 1961 (P.L.987, No.442), known
as the Pennsylvania Prevailing Wage Act, shall be paid to each
workman employed on an eligible project.
Section 4. Applicability.
The minimum requirements of section 3 shall apply to the
minimum wages and employee benefits due and payable to and on
behalf of any worker, in every trade or craft, employed by a
contractor, of any tier, performing services on an eligible
project after the effective date of this act.
Section 5. Effective date.

This act shall take effect immediately.
