AN ACT
Amending Title 66 (Public Utilities) of the Pennsylvania
Consolidated Statutes, in rates and distribution systems,
further providing for valuation of acquired water and
wastewater systems.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1329 of Title 66 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
§ 1329. Valuation of acquired water and wastewater systems.

(f.1) Limitation on use of section.--Notwithstanding any
other provision of law, and whether or not the acquiring public
utility or entity and the selling utility agree to use the
procedure under this section, the procedure under this
subsection to determine the fair market value of the selling
utility shall only be used if the acquiring public utility can
meet the burden of proof required under section 1327(a)(3)
(relating to acquisition of water and sewer utilities) in regard

to the selling utility.

Section 2. The amendment of 66 Pa.C.S. § 1329 shall apply to
the acquisition of a water or wastewater system under 66 Pa.C.S.
§ 1327.
Section 3. This act shall take effect in 60 days.
