AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in fraud and abuse
control, providing for managed care plan prohibition.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 13, 1967 (P.L.31, No.21), known
as the Human Services Code, is amended by adding a section to
read:
Section 1419. Managed Care Plan Prohibition.--
Notwithstanding any other provision of law, a managed care plan
as defined in section 2102 of the act of May 17, 1921 (P.L.682,
No.284), known as "The Insurance Company Law of 1921," may not
refer or enter into a subcontract arrangement to provide
services defined and specified in the managed care plan
contracts with an entity where the entity or managed care plan
may self-refer for durable medical equipment and supply
services.

Section 2. All regulations and parts of regulations are
abrogated to the extent of any inconsistency with the provisions
of this act.
Section 3. This act shall take effect in 60 days.
