AN ACT
Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
Statutes, in other required equipment, providing for vehicle
doors and further providing for restraint systems.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 75 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 4538. Vehicle doors.
Except as otherwise provided and notwithstanding the
provisions of section 4107 (relating to unlawful activities), a
vehicle shall be equipped with doors of a type used as original
equipment. The doors shall open and close securely unless the
vehicle has been manufactured or modified to the extent that
there is no roof or side. If a vehicle is designed by the
manufacturer with removable doors for off-road use or
customization, the vehicle may be operated on highways of this
Commonwealth with nonoriginal equipment manufacturer doors,
provided that the vehicle shall have two properly functioning

side mirrors. As used in this section, "nonoriginal equipment
manufacturer doors" shall mean a vehicle door that is not
originally equipped by the manufacturer, including a tube door,
half door or net door.
Section 2. Section 4581(a)(2)(ii) and (b) of Title 75 are
amended to read:
§ 4581. Restraint systems.
(a) Occupant protection.--

(ii) (A) Except for children under 18 years of age
and except as provided in paragraphs (1) and (1.1) and
subparagraph (i), each driver and front seat occupant of
a passenger car, Class I truck, Class II truck, classic
motor vehicle, antique motor vehicle or motor home
operated in this Commonwealth shall wear a properly
adjusted and fastened safety seat belt system.
(B) The driver and each occupant of a vehicle
operating with nonoriginal equipment manufacturer
doors, as defined under section 4538 (relating to
vehicle doors) shall wear a properly adjusted and
fastened safety seat belt system at all times when
the vehicle is operating on a highway in this
Commonwealth.

(b) Offense.--Anyone who fails to comply with the provisions
of subsection (a)(1) or (1.1) commits a summary offense and
shall, upon conviction, be sentenced to pay a fine of $75. The
court imposing and collecting any such fines shall transfer the
fines thus collected to the State Treasurer for deposit in the

Child Passenger Restraint Fund, pursuant to section 4582
(relating to Child Passenger Restraint Fund). Anyone who
violates subsection (a)(2) or (3) commits a summary offense and
shall, upon conviction, be sentenced to pay a fine of $10. No
person shall be convicted of a violation of subsection [(a)(2)
(ii)] (a)(2)(ii)(A) unless the person is also convicted of
another violation of this title which occurred at the same time.
No costs as described in 42 Pa.C.S. § 1725.1 (relating to costs)
shall be imposed for summary conviction of subsection (a)(2) or
(3). Conviction under this subsection shall not constitute a
moving violation.

Section 3. All regulations and parts of regulations are
abrogated to the extent of any inconsistency with the provisions
of this act.
Section 4. This act shall take effect in 180 days.
