AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in charter schools, further providing
for funding for charter schools and providing for Federal
loans, loan forgiveness or grants received in fiscal years
2020 and 2021.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1725-A(a)(2) of the act of March 10, 1949
(P.L.30, No.14), known as the Public School Code of 1949, is
amended to read:
Section 1725-A. Funding for Charter Schools.--(a) Funding
for a charter school shall be provided in the following manner:

(2) For non-special education students, subject to section
1725.1-A(d), the charter school shall receive for each student
enrolled no less than the budgeted total expenditure per average
daily membership of the prior school year, as defined in section

2501(20), minus the budgeted expenditures of the district of
residence for nonpublic school programs; adult education
programs; community/junior college programs; student
transportation services; for special education programs;
facilities acquisition, construction and improvement services;
and other financing uses, including debt service and fund
transfers as provided in the Manual of Accounting and Related
Financial Procedures for Pennsylvania School Systems established
by the department. This amount shall be paid by the district of
residence of each student.

Section 2. The act is amended by adding a section to read:
Section 1725.1-A. Federal Loans, Loan Forgiveness or Grants
Received in Fiscal Years 2020 and 2021.--(a) A charter school,
cyber charter school or a regional charter school shall report
to the department by July 31, 2021, all loans received through
the United States Small Business Administration's Paycheck
Protection Program, other Federal loans, loan forgiveness or
grants received from Federal programs in the fiscal year ending
June 30, 2020, and the fiscal year ending June 30, 2021.
(b) The department shall publish the amount reported under
subsection (a) on the department's publicly accessible Internet
website.
(c) The department shall:
(1) Calculate the amount each charter school, cyber
school or regional charter school received under subsection
(a) per student using the most recent year's average daily
membership as defined in section 2501(3).
(2) Publish the amount calculated under clause (1) on
the department's publicly accessible Internet website.

(d) For the 2021-2022 school year, the amount to be paid to
charter schools, cyber schools or regional charter schools under
section 1725-A shall be reduced by subtracting the amount
calculated under subsection (c)(1) from the payment.
Section 3. This act shall take effect immediately.
