AN ACT
Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
"An act concerning elections, including general, municipal,
special and primary elections, the nomination of candidates,
primary and election expenses and election contests; creating
and defining membership of county boards of elections;
imposing duties upon the Secretary of the Commonwealth,
courts, county boards of elections, county commissioners;
imposing penalties for violation of the act, and codifying,
revising and consolidating the laws relating thereto; and
repealing certain acts and parts of acts relating to
elections," in nomination of candidates, providing for waiver
of nomination petition and affidavit requirements.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 3, 1937 (P.L.1333, No.320), known
as the Pennsylvania Election Code, is amended by adding a
section to read:
Section 910.1. Waiver of Nomination Petition and Affidavit
Requirements.--(a) Notwithstanding any other provision of law,
a nomination petition under this article by a candidate shall
not be required if any of the following applies-- (1) the
candidate is the incumbent officeholder and is seeking
renomination for the same office for which the nomination

petition would otherwise be required; (2) the candidate was
defeated for election or nomination for the same office in the
immediately preceding election cycle; or (3) the time period for
the collection of signatures for the nomination petition occurs
during a declaration by the Governor of disaster emergency under
35 Pa.C.S. ยง 7301(c) (relating to general authority of
Governor).
(b) Notwithstanding any other provision of law, if
subsection (a) applies, an affidavit under section 910 shall not
be required if none of the information provided in the affidavit
that accompanied the nomination petition for the same office in
the immediately preceding election cycle has changed.
(c) This section shall not apply for an election cycle that
immediately follows the redistricting process involving the
office that is the subject of the nominating petition under this
section.
Section 2. This act shall take effect immediately.
