AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in proprietary and official rights,
further providing for use of carts, cases, trays, baskets,
boxes and other containers.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 6712(h) of Title 18 of the Pennsylvania
Consolidated Statutes is amended to read:
ยง 6712. Use of carts, cases, trays, baskets, boxes and other
containers.

(h) Penalty.--The following shall apply:
(1) A person who violates [this section]:
(i) Subsection (e) commits a misdemeanor of the
third degree.
(ii) Any other subsection commits a summary offense
[and shall, upon conviction, be sentenced to pay a fine
not exceeding $300 or to imprisonment for not more than
90 days].

(2) Each violation shall constitute a separate offense.

Section 2. This act shall take effect in 60 days.
