AN ACT
Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
Statutes, in food protection, further providing for license
required.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 5703(j)(3) of Title 3 of the Pennsylvania
Consolidated Statutes is amended to read:
ยง 5703. License required.

(j) Fees.--The fees that may be charged under this
subchapter are as established by the licensor, if the licensor
is an entity other than the department, and shall be paid into
the city, borough, incorporated town, township or county
treasury. If the licensor is the department, the fees shall be
paid to the State Treasury through the department and are as

(3) For a renewal of a license or for issuing a license
to reflect a change of ownership: $82. For the period
beginning after December 31, 2020, and ending January 1,
2022, a retail food facility shall be exempt from the fee
under this paragraph if all of the following apply:
(i) The retail food facility's gross annual receipts
do not exceed $5,000,000 for the previous fiscal year.
(ii) The retail food facility lost more than 20% of
the retail food facility's monthly sales during the
declaration of disaster emergency issued by the Governor
on March 6, 2020, published at 50 Pa.B. 1644 (March 21,
2020), or any renewal of the declaration of disaster
emergency.
(iii) The retail food facility offers for sale or
otherwise provides food or drink for human consumption
through a dine-in service, catering, a bar or club,
church or fire hall.
(iv) The retail food facility does not operate as a
retail grocery store, convenience store, an on-the-farm
retail store, a farmers market or farm stand.

Section 2. This act shall take effect in 60 days.
