AN ACT
Amending the act of May 1, 1984 (P.L.206, No.43), entitled "An
act providing for safe drinking water; imposing powers and
duties on the Department of Environmental Resources in
relation thereto; and appropriating certain funds," further
providing for powers and duties of the Department of
Environmental Protection.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 5 of the act of May 1, 1984 (P.L.206,
No.43), known as the Pennsylvania Safe Drinking Water Act, is
amended by adding a subsection to read:
Section 5. Powers and duties of department.

(a.1) Lead testing.--The department shall monitor lead
levels in public water systems in accordance with the following:
(1) The department shall conduct testing for lead during
two consecutive six-month monitoring periods.
(2) The department shall assign each public water system
in this Commonwealth to a monitoring period. Each public

water system shall be tested for lead under paragraph (1).
(3) Following the initial monitoring periods, the
department shall continue annual testing of public water
systems for lead. The department may identify public water
systems that qualify for reduced monitoring. The monitoring
schedule shall be such that all sample sites of a public
water system subject to reduced monitoring are tested for
lead at least once every three years.
(4) A public water system established after the
effective date of this subsection shall be subject to
monitoring beginning with the following monitoring period.
(5) The results of lead testing conducted by the
department shall be made available on the department's
publicly accessible Internet website. At a minimum, the data
shall include lead levels for each public water system
tested, the date of testing and any follow-up measures taken
or planned.
(6) The lead testing shall occur in accordance with a
monitoring schedule established by the Environmental Quality
Board by regulation. In addition, the Environmental Quality
Board shall promulgate any other regulations necessary to
implement this subsection.

Section 2. This act shall take effect in 60 days.
