AN ACT
Amending the act of May 1, 1984 (P.L.206, No.43), entitled "An
act providing for safe drinking water; imposing powers and
duties on the Department of Environmental Resources in
relation thereto; and appropriating certain funds," further
providing for powers and duties of Environmental Quality
Board; and abrogating regulations.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 4 of the act of May 1, 1984 (P.L.206,
No.43), known as the Pennsylvania Safe Drinking Water Act, is
amended by adding a subsection to read:
Section 4. Powers and duties of Environmental Quality Board.

(a.1) Maximum contaminant levels.--
(1) Maximum contaminant levels adopted under subsection
(a) shall:
(i) Establish Statewide maximum contaminant levels
for Perfluorooctane Sulfonate, Perfluocooctanoic Acid and
other Per- and Polyfluoroalkyl substance compounds in

public drinking water systems in accordance with
evidence-based standards.
(ii) Establish Statewide maximum contaminant levels
for chromium-6 in public drinking water systems in
accordance with evidence-based standards.
(iii) Establish Statewide maximum contaminant levels
for 1,4 dioxane in public drinking water systems in
accordance with evidence-based standards.
(iv) Include a directive to consider limits on other
pollutants in public drinking water systems when two or
more other states have set limits or issued guidance on a
given pollutant.
(2) The Environmental Quality Board shall review maximum
contaminant levels adopted by other states and the studies
and scientific evidence reviewed by those states, and shall
adopt a maximum contaminant level protective of public health
and in no case exceeding any maximum contaminant level or
health advisory promulgated by the United States
Environmental Protection Agency. The Environmental Quality
Board shall annually review the latest peer-reviewed science
and independent or government agency studies and undertake
additional rulemaking if needed to comply with this
paragraph.
(3) Within 100 days of the effective date of this
subsection, the Environmental Quality Board shall commence
rulemaking to promulgate the regulations under this
subsection.

Section 2. Any regulation inconsistent with this act is
abrogated to the extent of any inconsistency with this act.

Section 3. This act shall take effect in 60 days.
