by school entities and postsecondary institutions during the
previous school year. The annual report card shall include the
following information:
(i) The number of reported alleged incidents of rape, sexual
assault, sexual harassment, dating violence and stalking.
(ii) The number of incidents that were investigated by each
school entity or postsecondary institution and the number of
cases processed through the disciplinary proceedings of the
school entity or postsecondary institution.
(b) The report card must be posted on the Department of
Education's publicly accessible Internet website.
(c) Information shall be reported in a manner that provides
appropriate protections for the privacy of individuals involved,
including, but not limited to, protection of the confidentiality
of an alleged victim and of the alleged perpetrator, consistent
with the Family Educational Rights and Privacy Act of 1974
(Public Law 90-247, 20 U.S.C. § 1232g).
(d) As used in this section, the following words and phrases
shall have the meanings given to them in this subsection unless
the context clearly indicates otherwise:
"Dating violence." As defined in section 1553.
"Domestic violence." The wilful intimidation, physical
assault, battery, sexual assault or other abusive behavior as
part of a systematic pattern of power and control perpetrated by
one intimate partner against another, including, but not limited
to, physical violence, sexual violence, psychological violence
and emotional abuse.
"Postsecondary institution." An institution of higher
education, a community college, a State-related institution or a
member institution of the State System of Higher Education.
