AN ACT
Amending the act of July 19, 1979 (P.L.130, No.48), entitled "An
act relating to health care; prescribing the powers and
duties of the Department of Health; establishing and
providing the powers and duties of the State Health
Coordinating Council, health systems agencies and Health Care
Policy Board in the Department of Health, and State Health
Facility Hearing Board in the Department of Justice;
providing for certification of need of health care providers
and prescribing penalties," in licensing of health care
facilities, providing for report of inventory by health care
facility.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of July 19, 1979 (P.L.130, No.48), known
as the Health Care Facilities Act, is amended by adding a
section to read:
Section 822. Report of inventory by health care facility.
(a) Report.--A health care facility licensed under this
chapter shall annually report to the department an inventory of
the health care equipment that is maintained in the health care
facility. The health care facility shall also report this
inventory to the department within 24 hours of the declaration
of an emergency, regardless of whether the declaration is due to

a natural disaster or public health emergency. For the duration
of the emergency, the health care facility shall report its
equipment in accordance with department regulations.
(b) Definition.--As used in this section, the term "health
care equipment" shall mean all of the following:
(1) Bed capacity of the health care facility and the
number of physical beds in the health care facility.
(2) Face masks, gowns, face shields and any other item
that is deemed to be personal protection equipment.
(3) Ventilators.
(4) IV or medical infusion pumps.
(5) Cardiac monitors.
(6) Any other items required by the department.
Section 2. This act shall take effect immediately.
