AN ACT
Amending Title 63 (Professions and Occupations (State Licensed))
of the Pennsylvania Consolidated Statutes, in powers and
duties, further providing for hearing examiners.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3105(b) of Title 63 of the Pennsylvania
Consolidated Statutes, added July 1, 2020 (P.L.575, No.53) is
amended to read:
ยง 3105. Hearing examiners.

(b) Regulations.--The commissioner, after consultation with
the licensing boards and commissions, shall have the power to
promulgate regulations specifying the procedural rules to be
followed by hearing examiners in the conduct of hearings in
disciplinary matters before a licensing board or licensing
commission. All proceedings shall comply with all of the
following:
(1) Proceedings shall be conducted in accordance with

the provisions of 2 Pa.C.S. (relating to administrative law
and procedure).
(2) The respondent shall appear in person for a hearing
conducted under this act.
(3) An individual or entity, or an entity's
representative, adversely affected by the respondent's
actions which are relevant to the disciplinary matter pending
before the licensing board or commission or a hearing
examiner shall:
(i) have an opportunity to provide testimony at a
hearing concerning any loss, damages or injury suffered
as a direct result of the respondent's actions; or
(ii) have an opportunity to provide a written
statement concerning any loss, damages or injury suffered
as a direct result of the respondent's actions.
(4) Any written statement submitted pursuant to
paragraph (3) shall be presented to the hearing examiner.
Section 2. This act shall take effect in 60 days.
