AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in budget and finance,
establishing the Drug Recognition Expert Training Fund.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 42 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 3576. Drug Recognition Expert Training Fund.
(a) Fund established.--The Drug Recognition Expert Training
Fund is established as a special fund in the State Treasury.
Money in the fund may only be used for purposes of drug
recognition expert training, which shall include training of law
enforcement officers to detect if an individual is impaired by
or under the influence of alcohol, intoxicating liquor, drugs,
narcotics, controlled substances or other impairing or
intoxicating substances. Money in the fund and the interest
accruing thereon are appropriated to the Pennsylvania State
Police, upon approval of the Governor, to implement and

administer drug recognition expert training.
(b) Assessment.--In addition to any other costs that may be
imposed for a violation of 75 Pa.C.S. § 3802 (relating to
driving under influence of alcohol or controlled substance), an
assessment of $5 shall be imposed. Money collected shall be
transmitted to the State Treasurer for deposit in the fund.
(c) Definition.--As used in this section, the term "fund"
means the Drug Recognition Expert Training Fund.
Section 2. This act shall take effect in 60 days.
