
and any other powers and duties vested in and imposed upon
the joint committee by law.
(2) In discharging its function under section 7.1 of the
act of June 25, 1982 (P.L.633, No.181), known as the
Regulatory Review Act, if the joint committee determines that
a document should be promulgated as a regulation and orders
the agency EITHER to promulgate the document as a regulation
by the statutory deadline, the following apply:
(i) Subject to subparagraph (ii), the joint
committee may extend the promulgation deadline for up to
180 days if it determines that the agency is making a
good faith effort to promulgate the regulation in
accordance with:
(A) section 612 of the act of April 9, 1929
(P.L.177, No.175), known as The Administrative Code
of 1929;
(B) Article II of the act of July 31, 1968
(P.L.769, No.240), referred to as the Commonwealth
Documents Law;
(C) sections 204(b) and 301(10) of the act of
October 15, 1980 (P.L.950, No.164), known as the
Commonwealth Attorneys Act; and
(D) sections 5, 5.1, 5.2, 6, 7 and 8 of the
Regulatory Review Act.
(ii) No more than two extensions may be made.
Regardless of extensions, the promulgation deadline may
not extend beyond 18 months of the date of the original
order. OR TO DESIST FROM USE OF THE DOCUMENT IN THE
BUSINESS OF THE AGENCY AND IF THE AGENCY CHOOSES TO
PROMULGATE THE DOCUMENT AS A REGULATION, THE JOINT
