AN ACT
Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
"An act concerning elections, including general, municipal,
special and primary elections, the nomination of candidates,
primary and election expenses and election contests; creating
and defining membership of county boards of elections;
imposing duties upon the Secretary of the Commonwealth,
courts, county boards of elections, county commissioners;
imposing penalties for violation of the act, and codifying,
revising and consolidating the laws relating thereto; and
repealing certain acts and parts of acts relating to
elections," in electoral college, providing for requirements
of presidential electors and penalty and for advice from
attorney general.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 3, 1937 (P.L.1333, No.320), known
as the Pennsylvania Election Code, is amended by adding sections
to read:
Section 1503.1. Requirements of Presidential Electors and
Penalty.--Each presidential elector shall vote for the
presidential candidate and, by separate ballot, vice
presidential candidate who received the highest number of votes
at the preceding general election in this Commonwealth. If a
presidential elector fails to vote as required under this

section:
(1) The presidential elector shall immediately forfeit the
elector's office, the vote shall not be recorded, a vacancy
shall be declared and the presidential electors present shall
proceed to fill the vacancy as provided under section 1503.
(2) The presidential elector commits a misdemeanor.
Section 1503.2. Advice From Attorney General.--The
presidential electors may request advice from the Attorney
General in regard to the presidential electors' official duties.
Section 2. This act shall take effect in 60 days.
