AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in miscellaneous provisions relating
to institutions of higher education, providing for menstrual
hygiene products.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 2002-I. Menstrual hygiene products.
(a) General rule.--A public institution of higher education
shall make menstrual hygiene products available at no cost in
each bathroom of a school building.
(b) Products provided.--All of the following menstrual
hygiene products shall be made available under subsection (a):

(1) A choice of at least two sizes or absorbencies of
sanitary pads that are capable of absorbing at least five
milliliters of liquid.
(2) A choice of at least two sizes of tampons that are
capable of absorbing at least four milliliters of liquid.
(c) Regulations.--The department shall promulgate rules and
regulations necessary to implement and enforce the provisions of
this section.
(d) Definitions.--As used in this section:
"Menstrual hygiene products." Includes tampons, sanitary
napkins, menstrual sponges, menstrual cups and similar menstrual
hygiene products.
"Public institution of higher education." As defined in
section 2001-I.
"School building." A building owned by or under the control
of a public institution of higher education where classes are
taught on a regular basis. The term does not include student
dormitories.
Section 2. This act shall take effect in 60 days.
