AN ACT
Amending Title 53 (Municipalities Generally) of the Pennsylvania
Consolidated Statutes, in general provisions relating to
government and administration, providing for business of
security payments prohibited.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 53 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 1143. Business of security payments prohibited.
(a) Prohibition.--Money received by a city from the levy,
assessment and collection of a tax authorized by law may not be
used to pay a person engaged in the business of security if the
city disbands the police department of the city by vote,
ordinance, resolution or otherwise.
(b) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Business of security." As follows:

(1) The business of any of the following:
(i) An investigator.
(ii) A watch, guard or patrol agency.
(iii) A person that provides security to protect
persons or property.
(2) The term shall include, separately or collectively,
the making, for hire, reward or any consideration whatsoever,
of an investigation for the purpose of obtaining information
with reference to any of the following matters,
notwithstanding the fact that other functions and services
may also be performed for fee, hire or reward:
(i) Crime or wrongs done or threatened against the
Federal Government or a state or territory of the United
States.
(ii) The identity, habits, conduct, movements,
whereabouts, affiliations, associations, transactions,
reputation or character of a person or group of persons.
(iii) The credibility of witnesses or other persons.
(iv) The whereabouts of missing individuals.
(v) The location or recovery of lost or stolen
property.
(vi) The causes and origin of, or responsibility
for, fires, libels, losses, accidents, damage or injuries
to real or personal property.
(vii) The affiliation, connection or relation of a
person with a union, organization, society or association
or with an official member or representative thereof.
(viii) With reference to an individual seeking
employment in the place of another individual who quit
work by reason of a strike.

(ix) With reference to the conduct, honesty,
efficiency, loyalty or activities of an employee, agent,
contractor or subcontractor.
(x) The securing of evidence to be used before an
authorized investigating committee, board of award or
board of arbitration or in the trial of a civil or
criminal case.
(xi) The furnishing, for hire or reward, of
watchmen, guards, private patrolmen or other persons to:
(A) protect persons or property;
(B) prevent the theft or the unlawful taking of
goods, wares or merchandise;
(C) prevent the misappropriation or concealment
of goods, wares or merchandise, money, bonds, stocks,
choses in action, notes or other valuable documents,
papers or articles of value;
(D) procure the return of any of the items
listed under clause (C); or
(E) perform any other services associated with
those persons.
"City." A city of the first class, a city of the second
class, a city of the second class A or a city of the third
class.
"Person." An individual, corporation, partnership, limited
liability company, business trust, association, estate, trust,
foundation, society or other entity.
Section 2. This act shall take effect in 60 days.
