AN ACT
Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
act to consolidate, editorially revise, and codify the public
welfare laws of the Commonwealth," in departmental powers and
duties as to supervision, providing for requirements specific
to school-age programs.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 13, 1967 (P.L.31, No.21), known
as the Human Services Code, is amended by adding a section to
read:
Section 923. Requirements Specific to School-Age Programs.--
(a) Notwithstanding any other law, if a child is required to be
enrolled in school, is not enrolled and is not exempted from
enrollment under the act of March 10, 1949 (P.L.30, No.14),
known as the Public School Code of 1949, a child care facility
or children's institution may not admit the child for care
during the hours when the child is required by law to attend
school, except during a declaration by the Governor of disaster

emergency under 35 Pa.C.S. ยง 7301(c) (relating to general
authority of Governor) that eliminates or curtails in-person
learning.
(b) This section shall not affect other educational
compliance requirements for a school.
(c) As used in this section, the following words and phrases
shall have the meanings given to them in this subsection unless
the context clearly indicates otherwise:
"School" means a public or private school under the Public
School Code of 1949, including, but not limited to, a charter
school, regional charter school, intermediate unit, area career
and technical school or entity in which a resident of this
Commonwealth may legally fulfill the compulsory school
attendance requirements of the Public School Code of 1949 and
which meets the requirements of Title VI of the Civil Rights Act
of 1964 (Public Law 88-352, 78 Stat. 241).
Section 2. This act shall take effect immediately.
