AN ACT
Amending Title 45 (Legal Notices) of the Pennsylvania
Consolidated Statutes, in legal advertising, providing for
methods for advertising.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 45 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 311. Methods for advertising.
(a) General rule.--Notwithstanding any other provision of
law or regulation, whenever an advertisement or notice is
required by law, rule or regulation, a local government unit
shall satisfy the requirement by using one of the following
methods:
(1) A newspaper of general circulation as defined in
section 101 (relating to definitions) printed in the county
in which the government unit is located.
(2) A newspaper printed in the government unit, if there
is such a newspaper.

(3) A newspaper circulating generally in the government
unit.
(4) A legal newspaper designated by the rules of court
of the county in which the government unit is located for the
publication of legal notices and advertisements.
(5) The government unit's official, publicly accessible
Internet website using hypertext markup language (HTML)
format or an equivalent language format.
(6) The official, publicly accessible Internet website
of a newspaper listed in paragraph (1), (2), (3) or (4),
using HTML format or an equivalent language format.
(7) A community paper of mass dissemination.
(b) Additional requirements.--Using an option under
subsection (a) to satisfy the requirement to publish an
advertisement or notice required by law, rule or regulation does
not relieve a government unit of the requirement to publish in a
legal journal if otherwise required under section 308 (relating
to additional publication in legal journals) or any other
provision of law.
(c) Definition.--As used in this section, the term
"community paper of mass dissemination" means a locally
circulated printed publication that is at least four pages long,
is issued on at least a weekly basis and is distributed by
audited carriers to all known addresses within a political
subdivision.
Section 2. This act shall take effect in 60 days.
