AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in offenses against the family,
providing for the offense of domestic violence in the
presence of a minor.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 18 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 4307. Domestic violence in the presence of a minor.
(a) General rule.--The commission of any of the following
offenses against a family or household member in the presence of
a child 18 years of age or under shall be a misdemeanor of the
first degree:
(1) An offense under Chapter 25 (relating to criminal
homicide).
(2) Section 2504 (relating to involuntary manslaughter).
(3) Section 2701 (relating to simple assault).
(4) Section 2702(a)(3), (4) and (5) (relating to

aggravated assault).
(5) Section 2705 (relating to recklessly endangering
another person).
(6) Section 2706 (relating to terroristic threats).
(7) Section 2709.1 (relating to stalking).
(8) Section 2718 (relating to strangulation).
(b) Separate offense.--An offense under subsection (a) shall
be separate from the underlying offenses listed under subsection
(a)(1) through (8).
(c) Presence.--For the purposes of this section, presence
shall mean in the view or hearing of the child.
Section 2. This act shall take effect in 60 days.
