AN ACT
Amending Title 35 (Health and Safety) of the Pennsylvania
Consolidated Statutes, in Commonwealth services, further
providing for general authority of Governor.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 7301(f)(1) of Title 35 of the
Pennsylvania Consolidated Statutes is amended and the section is
amended by adding a subsection to read:
§ 7301. General authority of Governor.

(f) Additional powers.--In addition to any other powers
conferred upon the Governor by law, the Governor may:
[(1) Suspend the provisions of any regulatory statute
prescribing the procedures for conduct of Commonwealth
business, or the orders, rules or regulations of any
Commonwealth agency, if strict compliance with the provisions
of any statute, order, rule or regulation would in any way

prevent, hinder or delay necessary action in coping with the
emergency.]

(g) Prohibition.--Notwithstanding subsection (f) or the act
of April 23, 1956 (1955 P.L.1510, No.500), known as
the Disease Prevention and Control Law of 1955, the Governor may
not order the closure of any business entity, school entity or
nonprofit organization or restrict the movement of any
individual in this Commonwealth pursuant to a declaration of a
disaster emergency under subsection (c).
Section 2. The amendment or addition of 35 Pa.C.S. § 7301(f)
(1) and (g) shall apply to the proclamation of disaster
emergency issued by the Governor on March 6, 2020, published at
50 Pa.B. 1644 (March 21, 2020), and any renewal of the state of
disaster emergency.
Section 3. This act shall take effect immediately.
