AN ACT
Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
"An act concerning elections, including general, municipal,
special and primary elections, the nomination of candidates,
primary and election expenses and election contests; creating
and defining membership of county boards of elections;
imposing duties upon the Secretary of the Commonwealth,
courts, county boards of elections, county commissioners;
imposing penalties for violation of the act, and codifying,
revising and consolidating the laws relating thereto; and
repealing certain acts and parts of acts relating to
elections," in nomination of candidates, providing for
nomination of candidates during disaster emergency.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 3, 1937 (P.L.1333, No.320), known
as the Pennsylvania Election Code, is amended by adding a
section to read:
Section 913.1. Nomination of Candidates During Disaster
Emergency.--Notwithstanding any other provision of this act, a
candidate for State office or for the office of Senator or
Representative in the General Assembly may not circulate or file
a nomination petition during a disaster emergency as defined
under 35 Pa.C.S. § 7102 (relating to definitions) and declared

in accordance with 35 Pa.C.S. § 7301 (relating to general
authority of Governor). In lieu of circulating and filing a
nomination petition, each candidate for the office shall file an
affidavit, as required under section 910, and shall pay a filing
fee of two hundred fifty dollars ($250). A certified check or
money order in payment of the filing fee shall be made payable
to the Commonwealth of Pennsylvania or to the county, as the
case may be, and shall be transmitted to the State Treasurer or
county treasurer and shall become part of the General Fund.
Section 2. This act shall take effect immediately.
