AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in theft and related offenses, further
providing for the offense of theft of leased property.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3932 of Title 18 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
ยง 3932. Theft of leased property.

(c.1) Defense.--It is a defense to the offense of theft of
leased property that the lessor, or any person on behalf of the
lessor, has made payments in connection with the lease of such
property which exceed the retail value of the property stated
in the contract. If the retail value of the property is not
stated in the contract, the value of the leased property shall
be deemed not to exceed $50. A court may review the amount set
forth as retail value and, if it finds such value is not
reasonable, it shall set the retail value at $50 to determine if

a defense under this section applies.

Section 2. This act shall take effect in 60 days.
