AN ACT
Amending Titles 8 (Boroughs and Incorporated Towns) and 11
(Cities) of the Pennsylvania Consolidated Statutes, in powers
and duties of elected officials, further providing for
organization of council, quorum, participation by
telecommunication device, voting, compensation and
eligibility; and, in council, further providing for oath of
council members, quorum and rules.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1001(b) of Title 8 of the Pennsylvania
Consolidated Statutes is amended to read:
§ 1001. Organization of council, quorum, participation by
telecommunication device, voting, compensation and
eligibility.

(b) Quorum.--A majority of the membership of council then in
office shall constitute a quorum. Except as provided in
subsection (c)[,] and meetings held under 35 Pa.C.S. § 7501
(relating to general authority of political subdivisions), only
council members physically present at a meeting place within the

borough shall be counted in establishing a quorum.

Section 2. Section 11004(b) of Title 11 is amended to read:
§ 11004. Oath of council members, quorum and rules.

(b) Quorum.--
(1) A majority of the number of members of council shall
constitute a quorum.
(2) A smaller number may compel the attendance of absent
members, under penalties to be prescribed by ordinance.
(3) [Only] Except for meetings held during a declaration
of disaster emergency under 35 Pa.C.S. § 7301 (relating to
general authority of Governor) or 7501 (relating to general
authority of political subdivisions), only members physically
present at a meeting place within the city shall be counted
in establishing a quorum.

Section 3. This act shall take effect immediately.
