AN ACT
Providing for industrial business reporting relating to COVID-19
and for duties of the Department of Health.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the COVID-19
Industrial Business Data Reporting Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"COVID-19." As identified in the proclamation of disaster
emergency issued by the Governor on March 6, 2020, published at
50 Pa.B. 1644 (March 21, 2020), and any renewal of the state of
disaster emergency.
"Department." The Department of Health of the Commonwealth.
"Employee." An individual employed by an industrial business
in this Commonwealth.

"Industrial business." A commercial, industrial or other
enterprise with in-person operations in a building of at least
50,000 square feet.
Section 3. Industrial business reporting requirements.
(a) General rule.--An industrial business shall report to
the department the following information:
(1) The number and results of employees who have been
tested for COVID-19.
(2) The number of COVID-19-related deaths among
employees.
(3) The number of employees who have recovered from
COVID-19.
(4) The total number of employees who are employed by
the industrial business.
(b) Reporting.--The information required to be reported
under subsection (a) shall be reported by an industrial business
to the department daily in a form and manner as prescribed by
the department.
(c) Publication.--The department shall publish the following
data on the department's publicly accessible Internet website:
(1) The percentage of employees who have tested positive
and negative, respectively, for COVID-19 at each industrial
business.
(2) The percentage of employees who have pending test
results for COVID-19 at each industrial business.
(3) The percentage of employees working at each
industrial business who have died as a result of COVID-19.
(4) The percentage of employees working at each
industrial business who have recovered from COVID-19.
Section 4. Expiration.

This act shall expire upon termination, by executive order,
proclamation or operation of law, of the declaration of disaster
emergency issued by the Governor on March 6, 2020, published at
50 Pa.B. 1644 (March 21, 2020).
Section 5. Effective date.
This act shall take effect immediately.
