AN ACT
Amending Title 35 (Health and Safety) of the Pennsylvania
Consolidated Statutes, in Commonwealth services, providing
for emergency unemployment compensation assistance.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 35 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 7309. Emergency unemployment compensation assistance.
(a) Additional employees.--If a state of disaster emergency
declared or renewed by the Governor under section 7301(c)
(relating to general authority of Governor) is likely to cause a
sudden and significant increase in unemployment claims in this
Commonwealth, the Governor shall hire additional employees or
reassign employees from other Commonwealth departments, boards
or commissions, including full-time and part-time furloughed
employees, in accordance with sections 501 and 502 of the act of
April 9, 1929 (P.L.177, No.175), known as The Administrative
Code of 1929, for the Office of Unemployment Compensation and

unemployment compensation service centers to ensure that
eligible claimants are able to receive the benefits provided
under the act of December 5, 1936 (2nd Sp.Sess., 1937 P.L.2897,
No.1), known as the Unemployment Compensation Law. The
Department of Labor and Industry shall hire additional employees
or reassign Commonwealth employees under this subsection
commensurate with need.
(b) Determination.--In determining whether a state of
disaster emergency declared or renewed by the Governor under
section 7301(c) is likely to cause a sudden and significant
increase in unemployment claims in this Commonwealth, the
Governor, in conjunction with the Secretary of Labor, shall
consult with all of the following:
(1) The chair and minority chair of the Labor and
Industry Committee of the Senate.
(2) The chair and minority chair of the Labor and
Industry Committee of the House of Representatives.
(c) Health and safety.--The Department of Labor and Industry
shall hire additional employees or reassign Commonwealth
employees under subsection (a) in a manner that preserves the
health and safety of the employees at the Office of Unemployment
Compensation and unemployment compensation service centers.
(d) Applicability.--This section shall apply to a state of
disaster emergency declared or renewed by the Governor under
section 7301(c) before, on or after the effective date of this
section.
Section 2. This act shall take effect immediately.
