AN ACT
Amending the act of May 3, 1933 (P.L.242, No.86), entitled "An
act to promote the public health and safety by providing for
examination, licensing and granting of permits for those who
desire to engage in the profession of cosmetology; defining
cosmetology, and regulating cosmetology salons, schools,
students, apprentices, teachers, managers, manicurists and
cosmetologists; conferring powers and duties upon the
Commissioner of Professional and Occupational Affairs of the
Department of State; providing for appeals to certain courts
by applicants and licensees; and providing penalties,"
further providing for regulations by board.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 11 of the act of May 3, 1933 (P.L.242,
No.86), referred to as the Cosmetology Law, is amended to read:
Section 11. Regulations by Board.--(a) The board after at
least one public hearing shall prescribe reasonable regulations
for its conduct, and for the examination and licensing of
applicants to practice or teach cosmetology, for temporary
licenses to be issued by the department, and generally for the
conduct of persons, copartnerships, associations or corporations

affected by this act.
(b) Notwithstanding any other provision of law or regulation
to the contrary:
(1) The board shall not have the authority to require any
minimum floor space or impose any floor space limitations on
salons as a condition of licensure.
(2) An applicant for a salon license may submit a sketch
plan to the board showing the layout of the salon, including the
position of the doors, windows, partitions, shampoo basins,
lavatories, adjustable chairs and other floor equipment, prior
to the commencement of construction. Following a review of the
sketch plan, the board shall inform the applicant whether the
sketch plan is in compliance with facility requirements of this
act and 49 Pa. Code Ch. 7 (relating to State Board of
Cosmetology).
Section 2. The provisions of 49 Pa. Code § 7.76 are
abrogated. The provisions of 49 Pa. Code § 7.51 are abrogated
insofar as they are inconsistent with the amendment of section
11 of the act.
Section 3. This act shall take effect in 60 days.
