AN ACT
Amending Titles 18 (Crimes and Offenses), 23 (Domestic
Relations) and 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in sexual offenses,
further providing for the offense of female mutilation; in
child protective services, further providing for definitions
relating to child protective custody; and, in limitation of
time, further providing for infancy, insanity or imprisonment
and for no limitation applicable.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3132 of Title 18 of the Pennsylvania
Consolidated Statutes is amended by adding subsections to read:
§ 3132. Female mutilation.

(d.1) Revocation of licenses.--A physician who is convicted
of an offense under subsection (a) shall, in addition to the
penalty prescribed under this section, be subject to revocation
of the physician's license in accordance with the Osteopathic
Medical Practice Act or the Medical Practice Act of 1985, as
applicable.
(d.2) Public education and outreach.--The Attorney General,

in consultation with the Department of Human Services, shall
conduct an educational and outreach program for law enforcement
officers, social workers, teachers and guidance counselors. The
purpose of the program shall be to provide information relating
to identifying minors who are at-risk of becoming victims of an
offense under subsection (a) and of the duty to report under 23
Pa.C.S. Ch. 63 (relating to child protective services).

Section 2. Section 6303(b.1) of Title 23 is amended by
adding a paragraph to read:
§ 6303. Definitions.

(b.1) Child abuse.--The term "child abuse" shall mean
intentionally, knowingly or recklessly doing any of the
following:

(11) Committing an offense under 18 Pa.C.S. § 3132
(relating to female mutilation).

Section 3. Section 5533(b)(2) of Title 42 is amended by
adding a subparagraph to read:
§ 5533. Infancy, insanity or imprisonment.

(b) Infancy.--

(2) * * *
(ii.1) For purposes of this paragraph, the term
"sexual abuse" shall also include an offense under 18
Pa.C.S. § 3132 (relating to female mutilation).

Section 4. Section 5551 of Title 42 is amended by adding a
paragraph to read:
§ 5551. No limitation applicable.
A prosecution for the following offenses may be commenced at
any time:

(8) An offense under 18 Pa.C.S. § 3132 (relating to
female mutilation).
Section 5. This act shall take effect as follows:
(1) This section shall take effect immediately.
(2) The addition of 42 Pa.C.S. §§ 5533(b)(2)(ii.1) and
5551(8) shall take effect upon first passage of House Bill
No. 963, Printer's No. 1130 (2019), by both chambers of the
General Assembly or immediately, whichever is later.
(3) The remainder of this act shall take effect in 60
days.
