AN ACT
Amending Title 74 (Transportation) of the Pennsylvania
Consolidated Statutes, establishing the Pavement Advisory
Committee and providing for its powers and duties.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 74 of the Pennsylvania Consolidated
Statutes is amended by adding a chapter to read:

§ 9701. Definitions.
The following words and phrases when used in this chapter
shall have the meanings given to them in this section unless the
context clearly indicates otherwise:

"Committee." The Pavement Advisory Committee established
under section 9702 (relating to Pavement Advisory Committee).
"Department." The Department of Transportation of the
Commonwealth.
§ 9702. Pavement Advisory Committee.
(a) Establishment.--The Pavement Advisory Committee is
established under the jurisdiction of the department.
(b) Composition of committee.--The committee shall consist
of the following members:
(1) The Secretary of Transportation.
(2) The chairperson of the Pennsylvania Turnpike
Commission.
(3) The chairperson and minority chairperson of the
Transportation Committee of the Senate.
(4) The chairperson and minority chairperson of the
Transportation Committee of the House of Representatives.
(5) Six members from the pavement industry. Each member
representing the pavement industry shall be familiar with the
best practices in pavement procurement processes and pavement
maintenance and construction. The pavement industry members
shall be appointed by the Governor as follows:
(i) Three members representing the concrete pavement
industry.
(ii) Three members representing the asphalt pavement
industry.
(6) One member from the general public, to be appointed
by the Governor.
(c) Member alternates.--Each member of the committee may
designate an alternate to serve in the member's position on the
committee. Each member shall notify the committee chair in

writing of the designation.
(d) Terms of appointees.--The terms of all members of the
committee appointed by the Governor shall be for three years. A
member of the committee may be reappointed for additional terms.
An individual appointed to fill a vacancy shall serve for the
unexpired term and shall be eligible for reappointment.
(e) Officers.--The members of the committee shall annually
elect a chairperson, a vice chairperson and a secretary from
among the pavement industry members of the committee.
(f) Meetings.--
(1) The committee shall meet at least three times
annually.
(2) A member who misses three consecutive meetings
without good cause acceptable to the chairperson may be
replaced by the Governor.
(g) Expenses.--The pavement industry members and the general
public member shall be allowed actual, necessary and reasonable
per diem expenses in accordance with regulations of the
Executive Board. The department shall provide appropriate staff
support to enable the committee to properly carry out its
functions.
§ 9703 . Powers and duties of committee.
The committee shall assess, evaluate and make recommendations
related to the competitive pavement selection process,
including, but not limited to, the following:
(1) Reviewing and making recommendations on the usage of
various pavement procurement processes to ensure that
competition is achieved and to monitor the number of bids
received on paving projects using various procurement
processes.

(2) Reviewing pavement policies and practices and making
recommendations related to bringing a level of consistent
application across the department's engineering districts and
the Pennsylvania Turnpike.
(3) Studying the effect that competition, both inter-
industry and intra-industry, has on the unit costs of
pavement.
(4) Evaluating the cost per lane-mile-year of various
pavement strategies.
(5) Making recommendations to the department about cost
savings as related to the Motor License Fund.
(6) Making recommendations for implementation of tools
and new technologies that have the potential for stimulating
pavement competition and achieving long-term savings.
(7) Making recommendations for methods for improving
safety and protecting the environment as related to surface
characteristics and usage of pavement materials.
(8) Providing a forum for the exchange of information
and making recommendations on the pavement selection process.
(9) Considering any other issue raised that is related
to the quality, usage and competitiveness of the pavement
industry.
§ 9704 . Reports.
The committee shall submit reports of its deliberations and
conclusions to the Governor, members of the General Assembly and
State Transportation Commission.
Section 2. This act shall take effect in 60 days.
