AN ACT
Amending Title 34 (Game) of the Pennsylvania Consolidated
Statutes, in protection of property and persons, further
providing for protective material required.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 2524 of Title 34 of the Pennsylvania
Consolidated Statutes is amended to read:
§ 2524. Protective material required.
(a) General rule.--[Unless further restricted by regulations
of the commission, every person hunting for or assisting to hunt
for deer, bear or woodchucks shall wear either a minimum of 250
square inches of daylight fluorescent orange-colored material on
the back and front combined or, in lieu thereof, a hat of the
same color material. The material shall be worn so it is visible
in a 360-degree arc. Unless otherwise specified by regulations
of the commission, the provision of this section shall not apply
to any season for using muzzle-loading firearms only or season
for using bows and arrows only.] Except as otherwise provided by

commission regulation, it is unlawful to hunt, take, injure or
kill game or wildlife or aid, abet, assist, attempt or conspire
to hunt, take, injure or kill game or wildlife without wearing a
minimum of 250 square inches of daylight fluorescent orange-
colored or fluorescent pink-colored material on the head, chest
and back combined so that it is visible in a 360 ° arc. This
requirement shall apply while moving to or from a hunting
location while outside of a motor vehicle from one hour before
legal hunting hours to one hour after legal hunting hours.
Except as provided by commission regulation, camouflage daylight
fluorescent orange-colored or fluorescent pink-colored clothing
is lawful provided it contains the minimum amount of fluorescent
orange-colored or fluorescent pink-colored material.
(a.1) Additional requirements.--It is unlawful to hunt
during any firearms season for deer, bear or elk from any blind
meeting the requirements in section 2308(b)(3) (relating to
unlawful devices and methods) without placing a minimum of 100
square inches of daylight fluorescent orange-colored or
fluorescent pink-colored material within 15 feet from the blind
so it is visible in a 360° arc.
(a.2) Regulations.--The commission shall promulgate
regulations establishing applicable times, seasons and manner
that the protective material requirements in subsections (a) and
(a.1) may be reduced or exempted.
(b) Penalty.--A violation of this section is a summary
offense of the fifth degree.
Section 2. This act shall take effect in 60 days.
