AN ACT
Amending Title 62 (Procurement) of the Pennsylvania Consolidated
Statutes, in purchase of surplus Federal property, providing
for approval and reports.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 62 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
§ 4103. Approval and reports.
(a) Resolution.--An application for enrollment of a law
enforcement agency, which is working on behalf of a local
government unit, in a program established by the United States
Department of Defense under 10 U.S.C. § 2576a (relating to
excess personal property: sale or donation for law enforcement
activities) must be approved by a resolution adopted by a
majority of the full membership of the governing body of the
local government unit prior to the transmittal of the
application. The resolution must state that a public hearing was
conducted on the resolution before adoption.

(b) Report by law enforcement agency.--A law enforcement
agency working on behalf of a local government unit shall
provide an annual report to the governing body of the local
government unit specifying all the equipment secured through
subsection (a) that remains in the possession of the law
enforcement agency and whether that equipment has been deployed
during the previous 12 months.
(c) Report by Pennsylvania State Police.--The Pennsylvania
State Police shall provide an annual report to the Governor
specifying all the equipment secured through a program
established by the United States Department of Defense under 10
U.S.C. § 2576a and whether that equipment has been deployed
during the previous 12 months.
(d) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Local government unit." A county, city, borough,
incorporated town, township, school district, vocational school
district or home rule municipality.
Section 2. This act shall take effect in 60 days.
