AN ACT
Amending Title 66 (Public Utilities) of the Pennsylvania
Consolidated Statutes, in certificates of public convenience,
further providing for enumeration of acts requiring
certificate.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 1102 of Title 66 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
ยง 1102. Enumeration of acts requiring certificate.

(c) Uncontested telecommunication applications.--The
commission may not review an uncontested application of a
telecommunication public utility seeking any acquisition,
merger, sale of stocks, transfer of assets or transfer of
control which requires a certificate of public convenience for a
period of more than 60 days. Upon the expiration of the 60-day
review period, the application shall be deemed approved. In
reviewing an uncontested application under this subsection, the
commission may not:

(1) require or impose conditions on an applicant that
are dependent on a Federal or any other State proceeding
relating to the application filing ; or
(2) impose conditions of approval beyond the scope of
the commission's jurisdiction.
Section 2. This act shall take effect immediately.
