AN ACT
Amending Title 42 (Judiciary and Judicial Procedure) of the
Pennsylvania Consolidated Statutes, in particular rights and
immunities, providing for fee shifting in civil actions.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 42 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 8372. Fee shifting in civil actions.
When the defendant is the prevailing party in a civil action,
the attorney for the plaintiff shall be ordered to pay all
attorney fees and reasonable expenses of the defendant. The
amount of fees and expenses due shall be determined by court
order, upon petition of the defendant.
Section 2. This act shall take effect in 60 days.
