AN ACT
Amending the act of July 19, 1979 (P.L.130, No.48), entitled "An
act relating to health care; prescribing the powers and
duties of the Department of Health; establishing and
providing the powers and duties of the State Health
Coordinating Council, health systems agencies and Health Care
Policy Board in the Department of Health, and State Health
Facility Hearing Board in the Department of Justice;
providing for certification of need of health care providers
and prescribing penalties," in licensing of health care
facilities, providing for Culture and Quality of Life
Certification Program.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of July 19, 1979 (P.L.130, No.48), known
as the Health Care Facilities Act, is amended by adding a
section to read:
Section 822. Culture and Quality of Life Certification Program.
(a) Establishment.--The department shall establish a Culture
and Quality of Life Certification Program.
(b) Certification.--Long-term care nursing facilities may
apply for the special certification, through the department,
which shall recognize the facility's effort to create a home-

like environment and cultural opportunities for its residents,
including, but not limited to:
(1) An individual-centered approach to care.
(2) Social interactions.
(3) Partnerships with the community and volunteer
organizations.
(4) Participation of family and friends.
(5) Creative arts.
(6) Diversity of activities available to residents.
(7) Attention to cultural considerations.
(8) Creation of a home-like design aesthetic.
(9) Outdoor facilities such as patios, decks and
gardens.
(c) Regulations.--Regulations, including the application and
approval process, shall be promulgated by the department.
Section 2. This act shall take effect in 60 days.
