AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in school districts, requiring radon
reports; and, in grounds and buildings, requiring radon
tests.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding sections
to read:
Section 223.1. Radon Report.--The board of directors of each
school district shall provide written notice to the parent or
guardian of each student within ten (10) business days of the
start of the school year. The notice shall include the following
information:
(1) The date the radon testing under section 787 was
conducted in the school buildings in the school district in the
prior school year.

(2) The highest radon level recorded and the school building
where the level was recorded.
(3) A statement, if applicable, that no testing has been
conducted in a particular school building.
(4) A statement that the United States Environmental
Protection Agency considers radon levels above four (4)
picocuries per liter to be potentially dangerous.
Section 787. Radon Testing.--(a) Each school district shall
complete initial radon tests in school buildings in the school
district as follows:
(1) Except as set forth in paragraph (3), for a school
building in existence on the effective date of this section, by
June 30, 2019.
(2) For a school building constructed after the effective
date of this section, within nineteen (19) months of the date of
occupancy.
(3) For a school building in existence on the effective date
of this section but remodeled after the effective date of this
section, within nineteen (19) months of the date of completion
of the remodeling.
(b) Each school district shall continue to conduct radon
tests in school buildings in the school districts every five (5)
years after the initial test in subsection (a).
(c) The results of the radon tests shall be on file and
available for review at each school building within the school
district.
Section 2. This act shall take effect in 60 days.
