AN ACT
Amending Title 61 (Prisons and Parole) of the Pennsylvania
Consolidated Statutes, in miscellaneous provisions relating
to inmate confinement, providing for feminine hygiene
products.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 61 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 5908. Feminine hygiene products.
(a) Issuance.--
(1) A supply of feminine hygiene products shall be
provided to all incarcerated individuals and detainees in a
correctional institution each month at no cost to the
incarcerated individuals and detainees regardless of
financial means, gender identity or expression. The
correctional institution shall determine the quantity of
products and the frequency with which the products shall be

provided to incarcerated individuals and detainees.
(2) Incarcerated individuals and detainees shall not be
required to show proof of need to receive the products.
(3) Incarcerated individuals and detainees shall not be
required to undergo a medical examination or obtain a medical
permit, authorization or diagnosis to receive the products.
(b) Products provided.--The following products shall be
distributed to all incarcerated individuals and detainees in a
correctional institution:
(1) A choice of at least two sizes or absorbencies of
sanitary pads, capable of absorbing at least five milliliters
of liquid each.
(2) A choice of at least two sizes of tampons, capable
of absorbing at least four milliliters of liquid each.
(c) Rules and regulations.--The correctional institution
shall promulgate rules and regulations necessary to implement
and enforce the provisions of this section.
Section 2. This act shall take effect in 60 days.
