AN ACT
Amending Title 35 (Health and Safety) of the Pennsylvania
Consolidated Statutes, in Commonwealth services, providing
for certified fire protection specialist misrepresentation.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Chapter 73 of Title 35 of the Pennsylvania
Consolidated Statutes is amended by adding a subchapter to read:

CERTIFIED FIRE PROTECTION SPECIALIST MISREPRESENTATION

§ 7341. Scope of subchapter.
This subchapter relates to certified fire protection
specialist misrepresentation.
§ 7342. Fire protection specialist certification.
(a) Misrepresentation.--An individual who is not duly
certified as a fire protection specialist by the National Fire

Protection Association may not hold himself out as a certified
fire protection specialist with the intent to deceive another
person.
(b) Certification list.--To the greatest extent possible,
the Office of the State Fire Commissioner shall obtain and
maintain a current list of certified fire protection specialists
as provided by the National Fire Protection Association.
(c) Penalties.--An individual who violates subsection (a)
commits a summary offense and shall, upon conviction, be
sentenced as follows:
(1) For a first offense, to pay a fine of not more than
$250.
(2) For a second or subsequent offense, to pay a fine of
not more than $1,000 or imprisonment for not more than six
months, or both.
Section 2. This act shall take effect in 30 days.
