AN ACT
Amending Title 23 (Domestic Relations) of the Pennsylvania
Consolidated Statutes, in child protective services, further
providing for investigation of reports.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 6368(d) of Title 23 of the Pennsylvania
Consolidated Statutes is amended by adding a paragraph to read:
§ 6368. Investigation of reports.

(d) Investigative actions.--During the investigation, all of
the following shall apply:

(5) The SUBJECT TO THE CONFIDENTIALITY REQUIREMENTS OF
SECTION 6339 (RELATING TO CONFIDENTIALITY OF REPORTS), THE
county agency shall have access to and shall review each
record REQUESTED relating to the child, including medical
records, records of drug and alcohol treatment and school

records pursuant to the cooperation required under sections
6340.1 (relating to exchange of information) and 6346
(relating to cooperation of other agencies). NEI THER THE
CONSENT OF THE PARENTS NOR ANY OTHER RELEASE SHALL BE
REQUIRED TO PROVIDE THE RECORDS REQUESTED BY THE COUNTY
AGENCY. THIS PARAGRAPH SHALL ONLY APPLY TO THE EXTENT
PERMITTED BY FEDERAL LAW.

Section 2. This act shall take effect in 60 days.
