AN ACT
Amending Title 51 (Military Affairs) of the Pennsylvania
Consolidated Statutes, in Pennsylvania National Guard,
further providing for compensation of division commander or
equivalent; and making a related repeal.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 2304 of Title 51 of the Pennsylvania
Consolidated Statutes is amended to read:
§ 2304. Compensation of [division commander or equivalent]
military officers in service to the Commonwealth.
[When a general officer commanding a division or the
commanding officer of nondivisional troops equivalent in size to
a separate infantry brigade is permanently employed by the
Commonwealth in his command capacity, he shall receive the pay
in accordance with the current compensation plan of the
Commonwealth.] The following apply:
(1) The annual salary of the Adjutant General, Deputy
Adjutant Generals and general officers that require Federal

and State recognition for positions in the Pennsylvania
National Guard and who are permanently employed by the
Commonwealth shall be paid equivalent to the Federal military
base pay of the officer's federally recognized rank and time
of service, not to exceed 20 years.
(2) The cost-of-living adjustment shall be based on the
annually published active duty military pay scale.
Section 2. Repeals are as follows:
(1) The General Assembly declares that the repeal under
paragraph (2) is necessary to effectuate the amendment of 51
Pa.C.S. § 2304.
(2) Section 3(a) of the act of September 30, 1983
(P.L.160, No.39), known as the Public Official Compensation
Law, is repealed insofar as it is inconsistent with the
amendment of 51 Pa.C.S. § 2304.
Section 3. This act shall take effect January 1, 2020, or
immediately, whichever is later.
