AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in school district financial
recovery, providing for exemption from prevailing wage laws.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 696-A. Exemption from prevailing wage laws.
(a) General rule.--The provisions of the act of August 15,
1961 (P.L.987, No.442), known as the Pennsylvania Prevailing
Wage Act, shall not apply to a contract or proposed contract for
a "public work," as defined in that act, by a school district,
if the school district commits or otherwise obligates the
savings from the contract to the payment of the school
district's employer contribution under 24 Pa.C.S. Pt. IV

(relating to retirement for school employees).
(b) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"Savings from the contract." The amount to be paid in the
aggregate under a contract as if the prevailing wage rate were
required less the amount to be paid in the aggregate under the
contract without application of the prevailing wage rate.
Section 2. This act shall take effect in 60 days.
