AN ACT
Amending the act of November 23, 2010 (P.L.1083, No.108),
entitled "An act establishing a recycling program for certain
covered devices; imposing duties on manufacturers and
retailers of certain covered devices; providing for the
powers and duties of the Department of Environmental
Protection and for enforcement; establishing the Electronic
Materials Recycling Account in the General Fund; and
prescribing penalties," in administration, providing for
waiver for certain municipalities.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of November 23, 2010 (P.L.1083, No.108),
known as the Covered Device Recycling Act, is amended by adding
a section to read:
Section 511. Waiver.
(a) General rule.-- The department shall waive the provisions
of this act for consumers residing in a municipality, any part
of which is located more than five miles from the nearest
recycling facility participating in an approved plan under this
act to collect and process electronics for recycling.

(b) Expiration.--This section and all waivers granted under
this section shall expire 10 years from the effective date of
this section.
Section 2. This act shall take effect in 60 days.
