AN ACT
Amending the act of April 17, 2016 (P.L.84, No.16), entitled "An
act establishing a medical marijuana program; providing for
patient and caregiver certification and for medical marijuana
organization registration; imposing duties on the Department
of Health; providing for a tax on medical marijuana
organization gross receipts; establishing the Medical
Marijuana Program Fund; establishing the Medical Marijuana
Advisory Board; establishing a medical marijuana research
program; imposing duties on the Department of Corrections,
the Department of Education and the Department of Human
Services; and providing for academic clinical research
centers and for penalties and enforcement," in medical
marijuana organizations, providing for reissuance of permits
and further providing for limitations on permits.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 611 of the act of April 17, 2016 (P.L.84,
No.16), known as the Medical Marijuana Act, is amended to read:
Section 611. [(Reserved).] Reissuance of permits.
(a) Grower/processor permit.--If a grower/processor permit
issued under this act, excluding permits issued under section
2002, is surrendered, revoked or otherwise forfeited within two
years from the date of initial issuance, the department shall
issue the grower/processor permit to the next most qualified

applicant in the same region according to the department's
ranking and scoring in the application phase during which the
initial permit was issued.
(b) Dispensary permit.--If a dispensary permit issued under
this act, excluding permits issued under section 2002, is
surrendered, revoked or otherwise forfeited within two years
from the date of initial issuance, the department shall issue
the dispensary permit to the next most qualified applicant in
the same county within the same region according to the
department's ranking and scoring in the application phase during
which the initial permit was issued.
Section 2. Section 616 of the act is amended by adding a
paragraph to read:
Section 616. Limitations on permits.
The following limitations apply to approval of permits for
grower/processors and dispensaries:

(8) A grower/processor or dispensary shall immediately
surrender all permits granted under section 603 upon
application to the department to be a clinical registrant
under section 2002. The department shall reissue, in
compliance with section 611, any permits that have been
surrendered under this paragraph.
Section 3. This act shall take effect in 60 days.
