AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in school districts, providing for
publicly accessible school performance indexes or reports and
further providing for value-added assessment system.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 220.1. Publicly Accessible School Performance
Indexes or Reports.--(a) Beginning with the 2018-2019 school
year, the Department of Education shall establish a publicly
accessible Internet website that provides a o ne-stop location
for comprehensive information about school success in preparing
students for future readiness and an annual profile for each
public school and school district comprised of academic,
nonacademic, financial, demographic and related information. The

Internet website shall include, at a minimum, all of the
following:
(1) The indexes or reports of Federal accountability data in
accordance with the Every Student Succeeds Act or its successor
statute.
(2) The financial data required under Article VI-B.
(3) The information compiled under sections 220, 221, 222
and 603-B.
(4) The school performance profile data, including summative
district-level and building-level scores with regard to student
performance on assessments and academic growth, as provided
under section 1123 and under 22 Pa. Code Ch. 4 (relating to
academic standards and assessment).
(b) The Secretary of Education shall propose regulations for
promulgation by the State Board of Education with regard to the
calculation or inclusion of, or changes to, indicators or
measures which are necessary to comply with the replacement of
the No Child Left Behind Act of 2001 by the Every Student
Succeeds Act, including, but not limited to, all of the
following:
(1) Indicators or measures of adequate yearly progress.
(2) The implementation of subsequent changes in any
successor statute for the inclusion of school performance
profiles.
(c) As used in this section, the following words and phrases
shall have the meanings given to them in this subsection:
"Every Student Succeeds Act." The Elementary and Secondary
Education Act of 1965 (Public Law 89-110, 20 U.S.C. § 6311), as
amended by the Every Student Succeeds Act (Public Law 114-95,
129 Stat. 1802) or its successor statute.

"No Child Left Behind Act of 2001." The No Child Left Behind
Act of 2001 (Public Law 107-110, 115 Stat. 1425).
"School performance profile." The comprehensive overview of
student academic performance in a public school entity compiled
annually by the Department of Education.
Section 2. Section 221(b) of the act is amended to read:
Section 221. Value-added Assessment System.--* * *
(b) For purposes of this section:
"Value-added assessment system" shall mean a statistical
analysis of results on the Pennsylvania System of School
Assessment test, an assessment for Federal accountability under
the Every Student Succeeds Act (Public Law 114-95, 129 Stat.
1802) or any other test established by the State Board of
Education to meet the requirements of section 2603-B(d)(10)(i)
pursuant to 22 Pa. Code § 403.3 (relating to single
accountability system) that uses measures of student learning to
enable the estimation of school or school district statistical
distributions.
Section 3. This act shall take effect in 60 days.
