
enforcement functions, including, but not limited to, the act of
June 22, 1937 (P.L.1987, No.394), known as "The Clean Streams
Law," and the rules and regulations adopted thereunder; the act
of May 31, 1945 (P.L.1198, No.418), known as the "Surface Mining
Conservation and Reclamation Act;" the act of October 4, 1978
(P.L.851, No.166), known as the "Flood Plain Management Act,"
and the rules and regulations adopted thereunder; the act of
November 26, 1978 (P.L.1375, No.325), known as the "Dam Safety
and Encroachments Act," and the rules and regulations adopted
thereunder; and the act of July 7, 1980 (P.L.380, No.97), known
as the "Solid Waste Management Act," and the rules and
regulations adopted thereunder.
(a.1) Notwithstanding subparagraph (a), beginning on the
effective date of this subparagraph, each of the regulatory and
enforcement functions of the department under the following laws
that are conducted by the department on normal agricultural
operations, as defined in the act of June 10, 1982 (P.L.454,
No.133), referred to as the Right-to-Farm Law, shall by
agreement be delegated to the commission:
(i) "The Clean Streams Law" and the rules and regulations
adopted thereunder.
(ii) The "Flood Plain Management Act" and the rules and
regulations adopted thereunder.
(iii) The "Dam Safety and Encroachments Act" and the rules
and regulations adopted thereunder.
(iv) The "Solid Waste Management Act" and the rules and
regulations adopted thereunder.

Section 2. This act shall take effect in 60 days.
