AN ACT
Amending Title 58 (Oil and Gas) of the Pennsylvania Consolidated
Statutes, in development, further providing for protection of
water supplies.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 3218(b.4) of Title 58 of the Pennsylvania
Consolidated Statutes is amended and the section is amended by
adding a subsection to read:
ยง 3218. Protection of water supplies.

(b.4) Website.--The department shall publish[,] on its
Internet website[,]:
(1) lists of confirmed cases of subterranean water
supply contamination that result from hydraulic
fracturing[.]; and
(2) the results of the water analysis obtained and
completed by the department under subsection (b.6), which

must be categorized by municipality. The results may not
contain the name or address of the well owner or the exact
location of the well.

(b.6) Private water supply testing.--
(1) An owner of a private water supply who suspects that
the water supply has been polluted or diminished by the
drilling, alteration or operation of an oil or gas well may
request the department sample and test the private water
supply.
(2) If the department samples the private water supply,
the department shall provide the owner of the private water
supply with a copy of the department's report on the
laboratory results for the samples collected from the private
water supply and for the parameters that were accurately
tested and verified according to recognized and approved
testing methodologies.
(3) The department shall provide the copy of the
department's report on the results under paragraph (2) to the
owner of the private water supply within five working days
after the preparation of the report.

Section 2. This act shall take effect in 60 days.
