A CONCURRENT RESOLUTION
Directing the Congress of the United States to call for an
amendment convention pursuant to Article V of the
Constitution of the United States that shall be entitled the
Countermand Amendment Convention and limited to proposing an
amendment to the Constitution of the United States to grant
state legislatures authority to countermand and rescind any
mandate issued by any branch of the Federal Government or its
agencies that encroaches on states' rights and the personal
liberties of their citizens.
WHEREAS, Article IV, Section 4 of the Constitution of the
United States guarantees to every state a republican form of
government that gives each state equal standing when calling
for a Federal amendment convention; and
WHEREAS, Article V of the Constitution of the United States
reserves to the state legislatures the right to apply for an
Article V amendment convention for the purpose of proposing
amendments to the Constitution of the United States when
Congress, the courts or the executive branch refuse to address
an egregious wrong suffered by the people; and
WHEREAS, The state legislatures have the sole authority to
limit the agenda and authority of delegates and alternates they
send to a convention; and

WHEREAS, Under Article V of the Constitution of the United
States, Congress shall convene a convention as called for and
defined by two-thirds of the state legislatures; therefore be it
RESOLVED (the Senate concurring), That the General Assembly
of the Commonwealth of Pennsylvania hereby apply to Congress for
a Countermand Amendment Convention under the provisions of
Article V of the Constitution of the United States to propose a
countermand amendment to the Constitution of the United States
granting states the right to countermand and rescind any act of
any branch of the Federal Government or its agencies that
encroaches on states' rights and the personal liberties of their
citizens; and be it further
RESOLVED, That the General Assembly direct Congress to
convene the Countermand Amendment Convention within 60 days from
the date it receives the 34th call for this convention from a
state legislature; and be it further
RESOLVED, That a certified copy of this resolution be
transmitted by the Secretary of the Commonwealth to the
President of the United States Senate, the Speaker of the United
States House of Representatives, each member of the Pennsylvania
delegation to Congress and to the presiding officers of each
house of the state legislatures requesting their cooperation in
applying for a convention limited to the subject matter
contemplated by this application.
