AN ACT
Establishing the State Real Property Sale and Lease Review
Commission and providing for the commission's duties and for
a moratorium on the sale and lease of real property by the
Commonwealth.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the State Real
Property Sale and Lease Review Act.
Section 2. Definitions.
The following words and phrases when used in this act shall
have the meanings given to them in this section unless the
context clearly indicates otherwise:
"Commission." The State Real Property Sale and Lease Review
Commission established in section 3.
"Real property." Land, buildings, fixtures and other
improvements and interests which by custom, usage or law pass
with a conveyance of land though not described in the contract

of sale or instrument of conveyance.
"State real property." Real property belonging to the
Commonwealth and under the control of a department, board,
commission or other agency of the Commonwealth.
Section 3. State Real Property Sale and Lease Review
Commission.
(a) Establishment.--The State Real Property Sale and Lease
Review Commission is established.
(b) Members.--The commission shall consist of the following
members:
(1) Two members appointed by the Governor.
(2) One member of the Senate appointed by the President
pro tempore of the Senate.
(3) One member of the House of Representatives appointed
by the Speaker of the House of Representatives.
(4) One member appointed by the Majority Leader of the
Senate.
(5) One member appointed by the Majority Leader of the
House of Representatives.
(6) One member appointed by the Minority Leader of the
Senate.
(7) One member appointed by the Minority Leader of the
House of Representatives.
(8) The chairperson and minority chairperson of the
State Government Committee of the Senate, who shall be
nonvoting members.
(9) The chairperson and minority chairperson of the
State Government Committee of the House of Representatives,
who shall be nonvoting members.
(c) Appointments.--Appointing authorities shall make their

appointments within 60 days of the effective date of this
section.
(d) Meetings.---The commission shall meet as may be
necessary to complete and approve the study under section 4. The
initial meeting of the commission shall take place within 90
days of the effective date of this section.
(e) Chairperson.--The members of the commission shall elect
a chairperson from among its members.
(f) Quorum.--A quorum shall consist of a majority of the
members of the commission.
(g) Expenses.--A member of the commission shall serve
without compensation but shall be reimbursed for actual and
necessary expenses incurred in the performance of the member's
duties.
Section 4. Study and report.
(a) Conduct of study.--The commission shall conduct a study
of the practices and procedures used by the Commonwealth when
selling and leasing State real property. The purpose of the
study shall be to identify ways to maximize revenues from the
sale and lease of State real property. The study shall be
completed within four months of the commission's initial meeting
under section 3(d). A report of the study, including
recommendations, must be approved by the commission within one
month following completion of the study.
(b) Report.--The commission shall provide the report of the
study to the General Assembly.
Section 5. Moratorium on sale and lease.
The Commonwealth may not market, sell, lease or offer for
sale or lease any State real property during the nine-month
period following the date of enactment of this act.

Section 6. Expiration.
This act shall expire December 31, 2019.
Section 7. Effective date.
This act shall take effect January 1, 2019.
