AN ACT
Prohibiting certain benefit packages for children's health care
and medical assistance to include gender or sex reassignment
surgery or gender or sex transition services.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Short title.
This act shall be known and may be cited as the Taxpayer-
Funded Gender or Sex Reassignment Services Act.
Section 2. Restriction on use of children's health care benefit
package.
The benefit package for eligible children provided under
section 2302-A of the act of May 17, 1921 (P.L.682, No.284),
known as The Insurance Company Law of 1921, may not include
reimbursement for gender or sex reassignment surgery or gender
or sex transition services, including, but not limited to,
physician's services, inpatient and outpatient hospital
services, prescribed drugs or counseling services related to
such surgery or services.

Section 3. Restriction on use of medical assistance benefit
package.
A benefit package for medical assistance provided under
Subarticle (f) of Article IV of the act of June 13, 1967
(P.L.31, No. 21), known as the Human Services Code, may not
include reimbursement for gender or sex reassignment surgery or
gender or sex transition services, including, but not limited
to, physician's services, inpatient and outpatient hospital
services, prescribed drugs or counseling services related to
such surgery or services.
Section 4. Waivers from Federal Government.
The Department of Human Services shall request any waivers
necessary from the Federal Government which may be necessary to
implement the provisions of this act in a manner which does not
result in the loss of Federal funds allocated to the
Commonwealth.
Section 5. Effective date.
This act shall take effect in 60 days.
