AN ACT
Amending Title 18 (Crimes and Offenses) of the Pennsylvania
Consolidated Statutes, in assault, providing for the offense
of unauthorized implantation of microchip.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 18 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 2719. Unauthorized implantation of microchip.
(a) Offense defined.--A person commits an offense if the
person implants or causes to be implanted a microchip or other
device containing radio frequency identification technology
within another person's body without the prior written consent
of the other person.
(b) Public officers.--
(1) No court, judge, executive officer, administrative
agency or public employee of the Commonwealth or of any local
governmental body shall have power to issue any order
requiring a person to have a microchip or other device

containing radio frequency identification technology
implanted within the person's body.
(2) No court, judge, executive officer, administrative
agency or public employee of the Commonwealth or of any local
governmental body shall withhold, reduce or suspend or
threaten to withhold, reduce or suspend any benefits to which
a person would otherwise be entitled on the ground that the
person refuses to have a microchip or other device containing
radio frequency identification technology implanted within
the person's body.
(c) Grading.--An offense under this section or a violation
of subsection (b) is a misdemeanor of the first degree.
(d) Definition.--As used in this section, the term "radio
frequency identification technology" means a wireless
identification system that uses an electromagnetic radio
frequency signal to transmit data.
Section 2. This act shall take effect in 60 days.
